Child Law
In this update Alison Cleland of University of Strathclyde considers a wide variety of issues. A sheriff refuses a father’s application for contact with a child on the basis of the father’s violent character, while another sheriff grants a specific issue order that a child be known by the father’s surname, to remind the mother that the father should be involved in the child’s life. Expenses are awarded against a defender whose attitude that he had a right to the child had, in the view of the court, caused the litigation to be prolonged. A sheriff principal’s decision confirms that a child with special needs may be excluded from school. And in relation to child’s views in matters affecting them, a sheriff principal concludes that there is no need for a child to be consulted on more than one occasion. 2005.
